anatomic Terms of Use — version 0.3 Effective date: October 28, 2026

These Terms of Use are the agreement between you and SIMBIO LABS LTDA, CNPJ 69.798.123/0001-16, headquartered at Rua José Bonifácio, 1929, Centro, São Carlos, SP, 13560-610, Brazil ("Simbio", "we", "us"). They apply together with the Acceptance Terms (our usage rules) and the Privacy Policy. By creating an account and ticking the acceptance box, you agree to all three. If you do not agree, do not use anatomic.

1. What anatomic is

1.1. anatomic is an AI image generation and editing service, available through a web app and an API and paid for with prepaid credits.

1.2. anatomic allows adult content between adults, including nudity and sex, within the rules of the Acceptance Terms.

1.3. For now, anatomic is only available in Brazil.

2. Who can use it

2.1. anatomic is only for people aged 18 or older who are legally able to enter into this agreement.

2.2. Access to anatomic requires age verification through a reliable mechanism, carried out by anatomic ageproof, an in-house solution operated by SIMBIO LABS LTDA. Simply stating your age is not enough.

3. Your account

3.1. Every use of anatomic requires login. Your account is personal: do not share your password, session or API keys with anyone.

3.2. For security, your session may expire. When it does, just log in again.

3.3. Keep your password and keys secure. You are responsible for anything done with your account.

4. Usage rules

4.1. The full rules are in the Acceptance Terms. In short:

a) No minors. You may not generate sex, pornography or display of genitals for sexual purposes involving anyone under 18, even if simulated, edited or AI-generated. Images of children and teenagers with no sexual content are allowed.

b) Real people only with consent. You may use a real person's likeness, including with nudity, only if they are an adult who has given express consent. You keep the consent and show it to Simbio on request. If you don't, we treat it as no consent.

c) Nothing that is clearly a crime under Brazilian law.

4.2. You also may not try to get around age verification, usage limits or platform security, or resell access or API keys.

4.3. When you upload a photo of a real person as a reference, you confirm that you have their consent.

5. Your content

5.1. You are responsible for what you generate, upload and share with anatomic, and for how you use those images outside the platform.

5.2. The images you generate are yours, to the extent the law allows. What you upload stays yours.

5.3. You give Simbio a limited licence to store, process and show this content to you, to run and improve the service, comply with the law and enforce these terms. We do not publish your images or use them to promote anatomic without your consent.

5.4. In the future, we may use some generated images, always anonymised, to improve our models. You can object at any time by writing to privacidade@simbiolabs.com.br. Photos of real people uploaded as references are never included.

5.5. Images are kept in your account for as long as it exists and are deleted when you request deletion of your account. To delete a specific image, contact us through the privacy contact.

6. Monitoring and reports

6.1. Simbio continuously monitors use of the platform.

6.2. Anyone can report content by emailing contato@simbiolabs.com.br. People who appear in an image without having consented can request removal through the same channel. Reports of illegal or non-consensual content (anything involving minors, non-consensual intimate imagery, or deepfakes of real people) are acted on within 24 hours, and the content is removed immediately once confirmed. All other reports get a response within 7 days.

6.3. Simbio complies with court orders and requests from authorities as required by law.

7. Suspension and closure

7.1. If content or an account appears to break the rules, we may remove the content and suspend the account as a precaution while we review the case.

7.2. Before closing an account, we email you the reason and you may reply within 5 days. For violations involving minors, closure may be immediate.

7.3. If the violation is proven, the account is closed with no refund of credits.

7.4. You can close your account at any time by writing to contato@simbiolabs.com.br. It becomes inactive and your unused credits stay frozen on it, not lost. Later, you can ask us to reactivate the account or request a refund of your paid unused credits (section 8.4). To delete your data as well, see the Privacy Policy.

8. Credits and payments

8.1. Credits are prepaid, can only be used on anatomic, have no cash value, are not transferable and do not expire. Pack prices and the cost of each generation are shown in the app before you buy or generate.

8.2. Payments are processed by our third-party payment processor, which follows its own terms and handles your card details directly. Simbio never receives or stores your full card number. Charges appear on the card statement under a descriptor that identifies Simbio Labs or our payment processor, and the exact descriptor is shown at checkout before purchase.

8.3. Only active accounts with verified age can buy credits.

8.4. We return credits or, at your request, money in these cases: a) Our error: if a generation fails because of an error on Simbio's side, we return the credits spent on it; b) Change of mind: within 7 days of a purchase, you may withdraw and get back the value of that purchase's unused credits. This right applies on top of the other cases; c) Closure without violation: if Simbio shuts down the service or closes your account without a violation on your part, you may request a refund of your paid unused credits; d) New terms version: if you do not accept a new version, you may close your account and request a refund of your paid unused credits; e) Account closure: if you close your account, you may request a refund of your paid unused credits right away or later. Without a request, they stay frozen on the inactive account.

8.5. To request a refund, write to contato@simbiolabs.com.br. The money goes back to the original payment method within 10 business days after the request is approved. Free and promotional credits have no cash value and are not refunded.

8.6. If you dispute a payment directly with your bank or card issuer (chargeback), we may pause the account until the case is resolved.

9. The service

9.1. There may be outages, maintenance and feature changes. AI doesn't always get it right, so we don't guarantee every image will turn out exactly as you pictured it. If an image comes out against the rules without you asking for it, don't use or share it, and let us know at contato@simbiolabs.com.br.

9.2. If we decide to shut anatomic down, we will give at least 30 days' notice, and you may request a refund of your paid unused credits.

10. Liability

10.1. Simbio is liable for the damage it causes, as provided by law. Nothing in these terms limits your consumer rights.

10.2. Simbio is not liable for how you use images outside the platform or for the material you upload.

10.3. If Simbio faces a claim, lawsuit or fine because of something you did in breach of these terms or the law, you will compensate Simbio for its losses, including defence costs.

10.4. For businesses that are not consumers, Simbio's liability is limited to the amount paid in the 12 months before the event, except in cases of wilful misconduct or gross negligence.

11. Changes to these terms

11.1. When we publish a new version with material changes, you will need to accept it at your next login to keep using the service. We log each acceptance with the version, date and time, and IP address.

11.2. If you do not accept the new version, you may close your account and request a refund of your paid unused credits (section 8.4(d)). Wording fixes that do not change rights or obligations do not require re-acceptance.

12. Governing law and jurisdiction

12.1. These terms are governed by Brazilian law.

12.2. If you are a consumer, you may bring proceedings in the courts of your place of residence. In all other cases, the courts of São Carlos, São Paulo, Brazil have jurisdiction.
